Ponte Vedra Beach: Search continues for man who disappeared in November 2000

By SUSAN D. BRANDENBURG

Ponte Vedra Beach 543-0730

After graduating from Nease High School in 1996, Joshua Smith of Ponte Vedra Beach attended Flagler College in St. Augustine for 2 1/2 years. Named most valuable player in soccer his senior year at Nease (as well as "funniest senior"), Joshua was a starter on Flagler's freshman soccer team, pursuing a degree in sports management. For the first year, he lived at Flagler's dorm. Later, he shared an apartment on Anastasia Island with his buddy and fellow Nease graduate, Jeremy Wahl.

"Josh and Jeremy would come home some weekends and cook Chinese stir-fry for us," remembers Joshua's mom, Vicki Smith. "On those rare occasions when their apartment was clean, they used to invite me to St. Augustine for lunch." When Joshua decided to switch his major to coaching and transfer to FCCJ in the spring of 2000, he moved back home to Marsh Landing to live with his parents. Approximately six months after leaving Flagler College, Joshua Smith disappeared. He was last seen on Nov. 4, 2000, the day he turned 23 years old.

Joshua spent his birthday in close companionship with his dad, Ed, working out together at the Ponte Vedra Lodge and Club in the morning and going to a movie and dinner at Tinsel Town on the Southside in late afternoon. The last person in the family to see Joshua was his younger brother, Eric, who stopped by Lulu's Restaurant on Roscoe Road where Joshua was working that night.

"Eric remembers giving Josh a big birthday hug and $60 to buy some CDs," says Vicki Smith. "They weren't afraid to tell each other 'I love you.' They were as close as brothers can be. In fact, Joshua was a person who treasured his home, his family and his friends above all else. That's why I know in my heart that he did not intentionally leave us."

At 5 a.m. on Nov. 5, 2000, Ed Smith found Joshua's 1994 Ford Ranger Truck parked in front of the Lodge. Joshua's Tommy Hilfiger tennis shoes were found in the sand about 20 feet behind the Lodge. Dogs from the St. Johns County Sheriff's Office tracked him about a half-mile south on the beach and then lost his scent. "The obvious conclusion is that he drowned," says Vicki, "but the authorities told us that some evidence would have washed ashore, even if sharks got him." The distraught mother spent every night walking the beach until dawn for two weeks following Joshua's disappearance. "Beth Connor [Jeremy Wahl's mother] and Linda Donovan [mother of Nease graduate, Jimmy Donovan] helped us through those first awful days," gratefully recalls Vicki. "They distributed posters and drove continually up and down the beach from here to St. Augustine, but eventually, as weeks turned into months, everyone got back to their normal routines. Everyone, that is, but us."

For the Smiths, nearly two years after their son disappeared without a trace, there is no such thing as a normal routine anymore. Convinced that their son did not drown and did not disappear of his own volition, the Smiths remember a college friend of Ed's who suffered from amnesia.

They picture Joshua sitting dazed and helpless in some homeless shelter. They visit shelters relentlessly, looking into the eyes of each young man. "We've discovered that the homeless are also faceless to the general population," says Vicki. "It's as if they are invisible and untouchable. Through this tragedy, we've come to realize that every one of them is a human being who deserves to be recognized - just like our Josh." Relying on their deep faith in God, the Smiths pray daily that one of the faces will belong to Josh; that someone will remember something about the night Joshua disappeared; that there will be an end to this nightmare. Vicki searches the Internet constantly. She and Ed have become active members of a support group called Families of Missing Loved Ones, founded by Jacksonville Southsider Linda Rice when her 29-year old daughter, Tina McQuaig, disappeared in March of 2000. "Like the rest of us who have missing loved ones, the Smiths have left no stone unturned in their search for Joshua," says Rice. "We can never give up hope as long as there is some chance our children can be found." Vicki has heard comments from people who suggest that she is obsessed. "They feel that Josh drowned and that's too bad, but I need to just get over it and get on with life," says Vicki. "But what if he didn't drown? What if he's still out there somewhere? What if he was your son? Would you stop searching?"

This week, students at Flagler College and citizens of St. Augustine may run into an attractive lady with long, greying hair and searching, haunted eyes walking from store to store and building to building with posters in hand. She is looking for her beloved son, Joshua Smith, and she won't give up. Would you?

Sabine Musil-Buehler - Motel owner MISSING

Husband seeks declaration of death

Motel owner missing since November

By DUANE MARSTELLER - dmarsteller@bradenton.com

MANATEE — Nearly a year after a Holmes Beach motel owner disappeared, her estranged husband is seeking to have her declared legally dead.

There is evidence that Sabine Musil-Buehler “was abducted and killed” on Nov. 6, when she was last seen alive by anyone who knew her, Thomas E. Buehler said in a petition filed in Manatee County Circuit Court last week.

The three-page petition asks a judge to declare Musil-Buehler legally dead, thus allowing Buehler to collect on a life-insurance policy on her and become sole owner of Haley’s Motel. Musil-Buehler did not have a will, thus making her husband her sole heir, the petition said.

Typically under Florida law, a person must be missing at least five years before he or she can be declared legally dead. But an heir can seek a presumptive death certificate if there is evidence that the person was “exposed to a specific peril of death,” as Buehler’s petition contends.

Musil-Buehler’s body has not been found, and no charges have been filed in her disappearance.

She went missing Nov. 6 after an argument with her boyfriend, William Cumber. Later that day, authorities stopped her car, arrested the man driving it and found Musil-Buehler’s blood in it.

The driver, Robert Corona, was sentenced last month to four years in prison after pleading no contest to grand theft, resisting arrest and driving without a valid license. He has maintained that he is not involved in Musil-Buehler’s disappearance, saying he took the car after finding it with the keys in the ignition.

Cumber, the last person known to have seen Musil-Buehler alive, was sentenced in May to 13 years in prison for violating his probation on an unrelated arson conviction. He also has denied involvement in her disappearance.

Having Musil-Buehler declared legally dead could help the investigation into her disappearance, which the Manatee County Sheriff’s Office is treating as a homicide, spokesman Dave Bristow said.

A local crime fighting group, the Manatee County Gold Star Club, recently presented Sheriff Brad Steube with a $25,000 check to give law enforcement some help in getting information on Manatee County’s recent wave of homicides and home invasions. Bristow urged anyone with information in the case to call the sheriff’s office at 747-3011 or Manatee County Crime Stoppers at 866-634-TIPS (8477).

Duane Marsteller, transportation/growth and development reporter, can be reached at 745-7080, ext. 2630.

Missing woman’s ex pleads guilty

By ROBERT NAPPER - rnapper@bradenton.com

BRADENTON — William Cumber, the former boyfriend of missing motel owner Sabine Musil-Buehler and named a “person of interest” in her disappearance, pleaded guilty Tuesday to violating his probation on an arson conviction.

Cumber, 39, is the last person to have reported seeing Musil-Buehler alive. Musil-Buehler, 49, co-owner with her estranged husband of Haley’s Motel on Holmes Beach, has not been seen since Nov. 4.

In court Tuesday, Cumber pleaded guilty to driving with a suspended license while on probation after his arrest in December by Marion County authorities outside Ocala. He faces up to 30 years in prison and is scheduled to be sentenced May 14. Assistant State Attorney Tony Casoria said he will ask for the maximum sentence.

Cumber has denied any involvement in or knowledge of Musil-Buehler’s disappearance, and his attorney, Tom Ostrander, said he believes prosecutors are asking for the maximum based on the Musil-Buehler case, not on the facts of his probation violation.

On Nov. 6, Musil-Buehler’s estranged husband, Thomas Buehler, reported her missing after Manatee County Sheriff’s Office deputies pulled over a man driving her stolen car.

The driver, Robert Corona, admitted to stealing her car but claimed no knowledge of her disappearance, according to sheriff’s officials. Detectives found Musil-Buehler’s blood in her car.

Detectives focused on Cumber, naming him a “person of interest,” and collected evidence from the Holmes Beach apartment he shared with Musil-Buehler. His past arson conviction, in which he pleaded guilty to burning an ex-girlfriend’s house down, led to suspicion, according to sheriff’s spokesman Dave Bristow.

More suspicion came Cumber’s way when a duplex at Haley’s went up in flames two weeks after Musil-Buehler went missing. Holmes Beach police called the fire “suspicious” and named Cumber a “person of interest.”

On Tuesday, West Manatee Fire Rescue Capt. Tom Sousa said the Haley’s fire has officially been ruled an arson, but it unknown who started the fire.

Known Circumstances: Search on for missing McCleary girl

Police are asking the public’s assistance in locating a 10-year-old McCleary girl who did not return home Friday night from a visit with a friend. “I just need my daughter home,” said Melissa Baum, mother of Lindsey Baum. “Lindsey, please come home, you’re not in trouble.”

Lindsey Baum was wearing a hooded sweatshirt that was either gray or blue, jeans and black sneakers, was walking from her friend’s house on Maple Street to her own home on Mommsen Road, a four-block distance, and was last seen at about 9:15 p.m., said Sgt. Ed Patrick with the Grays Harbor Sheriffs Office.

Baum’s mother called the McCleary Police Department at 10:50 p.m., having waited in case her daughter had stopped to talk to her friend or otherwise dawdled, Patrick said. Melissa Baum said Lindsey wasn’t angry Friday night, and left without money, a change of clothes or her cellphone. Police have searched for the girl in the homes of her friends, in case she had been “hiding out.” “She wouldn’t have run away,” Baum said, her voice hoarse. “If she had been hiding she would have come out by now. She can’t hide that long, she loves to talk.”

Baum called her daughter a “mama’s girl,” and said the two were re-reading the Harry Potter books aloud to prepare for the upcoming movie. Lindsey wanted to have her friend over to read with them, and left while it was still light out. Chief George Crumb of the McCleary Police Department said friends and family are assisting the search, and that while his department hopes Baum just ran off on her own, “she’s been gone far too long.” Melissa Baum said she is afraid someone has taken her daughter, and taken her away from McCleary. “If anyone does have her, bring her back home or take her to a pay phone where she can call home,” Baum said.

In the five years Crumb has been with McCleary there has not been an abduction. No Amber Alert was initiated because no one had seen anyone take her. Lindsey Baum was simply reported as a missing child. “It did not meet any of the criteria for an Amber Alert,” Crumb said.
McCleary Police set up the initial search, but called in the Sheriffs Office at 4 a.m., Patrick said. Thurston County sheriffs deputies are also assisting.“We are keeping our fingers crossed,” Crumb said. Anyone with any information is urged to contact the Grays Harbor Emergency 911 Center at 360-533-8765 or the McCleary Police Department at 360-495-3107.

OCTOBER 19, 2009

(Video Synopsis written by Stephen Watkins)

A Newmarket, Ontario father, Stephen Watkins, has been searching for his missing children abducted to Europe for 7 months for his two abducted missing children, Alexander & Christopher Watkins in this incredible and sad International Parental Child Abduction story from Canada.

The biological father, Stephen Watkins, was awarded Final Sole Custody of the children by the Canadian Courts on January 26, 2009 after the children were apprehended by the Catholic Children Aid Society of Toronto (CCAS) on November 2007 over mental / physical abuse caused by the children's mother. The boys were placed in the Sole Custody Care of Stephen Watkins by the CCAS and Courts in December 2007 as he already had a Joint Custody Order issued on February 16, 2006.

The children have both been diagnosed with Post Traumatic Stress Disorder resulting of the care they received and Alexander, the oldest son, has been diagnosed with High Functioning Autistic Spectrum Disorder which has been denounced by the child's mother in previous Court proceedings.

A few weeks after the January 26th Court Ruling , Alexander WATKINS (7 yrs) and Christopher WATKINS (4 yrs) were abducted by Edyta Ustaszewski Watkins (non-custodial mother) and her father, Tadeusz Ustaszewski, during the weekend of March 6 2009, on a Court Ordered weekend access.

The children were driven into the US by the maternal grandfather and the children's non-custodial mother to catch a flight to Germany using Canadian Passports issued to the children who were Ordered by the Courts to be turned over multiple times and with the use of an adult SUSPENDED Canadian Passport used by the mother.

The adult passport was confirmed suspended 42 days prior to the abduction by Ontario's Family Responsibility Office (FRO) due to Provincial Enforcement Actions.

The father is being assisted in Canada by CHILD FIND ONTARIO, case director Terry Smith, MISSING CHILDREN SOCIETY OF CANADA, case director Barb Snider and two online organizations, HELP FIND MY CHILD and FOREVER SEARCHING.

WATKINS Story:

Both children have been flagged on Interpol with world wide YELLOW NOTICES for information on their whereabouts.
